PA Supreme Court Rules Game Commission Must Obtain Warrants Before Entering Private Lands

HARRISBURG — The Pennsylvania Supreme Court has ruled that state game wardens and other government officials generally must obtain a search warrant before entering certain privately owned land, concluding that the Pennsylvania Constitution provides stronger privacy protections than federal law.

The unanimous decision stems from a lawsuit filed by the Punxsutawney Hunting Club and Pitch Pine Hunting Club against the Pennsylvania Game Commission. The clubs challenged the longstanding use of the federal “open fields doctrine,” which has allowed game wardens and other law enforcement officers to enter private property without a warrant under certain circumstances.

The dispute centered on whether Pennsylvania’s constitutional protections against unreasonable searches and seizures extend beyond homes and buildings to privately owned land that has been clearly marked to keep the public out.

The court ruled that they do.

In its opinion, the court held that Article I, Section 8 of the Pennsylvania Constitution protects “the open fields of any landowner that has demonstrated a reasonable expectation of privacy by taking sufficient steps to exclude intruders.” As a result, government officials generally must obtain a warrant based on probable cause, or meet another recognized exception to the warrant requirement, before entering those properties.

The ruling applies to landowners who have taken reasonable steps to indicate their property is private, such as posting no-trespassing signs, using Pennsylvania’s authorized purple paint markings or erecting fences. The court did not decide whether the same protections apply to open, unmarked property.

The decision overturns decades of reliance on the federal open fields doctrine in Pennsylvania and establishes broader privacy protections under the state constitution than those provided by the Fourth Amendment to the U.S. Constitution.
